RENEWAL PAYMENTS. This is a rental agreement only. The initial term of the Agreement is noted on the front page of this Agreement. The client is not obligated to renew this Agreement beyond the initial term. Unless the client renews this Agreement, the property may be kept only until the return date listed on the front page of this Agreement. The initial rental rate plus applicable taxes thereon is payable on execution of this Agreement.
TERMINATION. All property returned to Maxim Medical Supplies must be in its present condition, cleaned, fair wear and tear accepted.
OPTION TO PURCHASE. If the client chooses to purchase the property any time after the first month on a private rental, Maxim Medical Supplies will deduct one (1) month’s rental fee from the Regular Retail Purchase Price plus applicable taxes. Some conditions and exceptions may apply.
RIGHT TO TAKE POSSESSION. If the client DOES NOT renew this agreement on or before the due date shown on the rental form, or breach any other important terms of this agreement, Maxim Medical Supplies has the immediate right to take possession of the property to Maxim Medical Supplies, all costs for taking possession of and removing the property include, to the extent permitted by law, our court costs and attorney’s fees will be the sole responsibility of the client.
LIABILITY AND INSURANCE. The client is fully and solely liable for damage to, or loss or destruction of, the property from any cause, including but not limited to theft and vandalism. If for any reason Maxim Medical Supplies is not given possession of the property upon termination of this Agreement, the client must pay us the full value of the property. The client is not required to maintain insurance coverage on the property, but is liable for damage to, or loss or destruction of, the property. Maxim Medical Supplies does not provide insurance and is not responsible for any injuries or casualties resulting from the use of the rented equipment.
TITLE AND MAINTENANCE. Maxim Medical Supplies retains title to the property at all times, and will maintain the property in good working order. Maxim Medical Supplies has the obligation to maintain the property in good working order. Maxim Medical Supplies has the obligation to maintain the property for the initial rental period, and any subsequent renewal terms. If there is a problem with the rented equipment, it is the client’s responsibility to contact Maxim Medical Supplies immediately. The client is responsible for the following maintenance of the rented property: Any maintenance or repair required by misuse, abuse, negligence, or accidental damage is the Client’s responsibility. Maxim Medical Supplies will not be responsible for the costs or results of any repairs done by others.
WARRANTY. There are no express warranties other than our agreement to maintain the property in good working order during the initial term of this Agreement.
NOTICE TO RENTER. (1) DO NOT SIGN THIS AGREEMENT BEOFRE YOU READ AND UNDERSTAND IT. (2) You are entitled to a copy of this Agreement completely filled in. (3) By signing this Agreement the client admits that they have received the property in satisfactory condition. (4) This is Maxim Medical Supplies’ entire Agreement. No oral statements or agreements will be valid.
